8.1 Product Availability

9. Shipping Policy
As we offer digital products only, there is no physical shipment or traditional delivery process. However, we aim to provide instant access to your purchased products. Below are the details regarding our digital delivery process:

In most cases, once your purchase is successfully completed, you will receive an email confirmation containing a link to download your digital product(s) immediately.
9.2 Delivery Delay (Up to 24 Hours)
While we strive to ensure immediate delivery, in rare cases, there may be a slight delay in processing your order. 9.3 No Shipping Fees
Since our products are digital, no physical shipping is involved, and therefore, no shipping charges will apply to your order. The price of the digital product is the total amount you will pay at checkout.
9.4 Technical Requirements

10. Refund Policy
Due to the nature of digital goods, which are non-returnable and cannot be "un-purchased" once downloaded or accessed, our refund policy differs from traditional physical product purchases. We offer refunds under specific circumstances as outlined below:
10.1 Eligibility for Refunds
We offer a 7- business day refund policy for digital goods, starting from the date of purchase. Refunds will only be issued if there is a technical issue that prevents you from accessing or downloading the product, and the issue cannot be resolved by our support team.
If you have already downloaded or accessed the digital product, refunds will not be provided, unless you can demonstrate that the product is defective or not as described.
10.2 Non-Refundable Situations
Once the digital product has been accessed or/and downloaded, it is non-refundable unless there is a proven technical failure or defect.
If you change your mind or simply no longer need the product, we unfortunately cannot offer a refund as the nature of digital goods means they cannot be returned.
Refunds will not be granted if the product is compatible with your device or software, but you choose not to use it.
10.3 How to Request a Refund
If you experience a technical issue with the product that prevents you from accessing or using it, or if the product is defective, please contact our support team immediately at [email protected] with the following details:
Your order number and email address used for the purchase.
A detailed description of the issue you are experiencing (including screenshots, if applicable).
Proof that the product is defective, or that you have been unable to download or access it.

10.4 Refund Process
If you submit your refund request within 7 business days of your purchase date, we require up to 7 additional business days to approve and process the refund.
Once approved, the refund will be issued to the original payment method used for the purchase. Please note that your bank or payment provider may require additional time to complete the transaction and reflect the funds in your account.
10.5 Exceptions
We do not offer refunds for:
Products purchased by mistake.
Products that have been fully downloaded, accessed, or used.
Issues resulting from user error or failure to meet the necessary technical requirements (such as outdated software or incompatible devices).
11. Intellectual Property Rights
11.1 Ownership of Content

12.2 Limitation of Liability
To the fullest extent permitted by law, Visual Market s.r.o. shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Website or any products or services purchased through the Website. Our total liability for any claim shall not exceed the amount you paid for the product or service that gave rise to the claim.
13. Dispute Resolution
13.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Czech Republic, without regard to its conflict of law principles.
13.2 Negotiation and Mediation
In the event of any dispute, claim, or controversy arising out of or in connection with these Terms, the parties agree to first attempt to resolve the issue through good faith negotiation. If the matter cannot be resolved through informal negotiation within 30 days, either party may request mediation before initiating any formal legal proceedings.
12.3 Arbitration
If the dispute cannot be resolved through negotiation or mediation, the parties agree to resolve the dispute by binding arbitration. The arbitration shall be conducted in the Czech Republic under the Rules of the Arbitration Court of the Economic Chamber of the Czech Republic and the Czech Agricultural Chamber. The arbitration proceedings will be held in Czech language, and the decision of the arbitrator shall be final and binding.
13.4 Venue and Jurisdiction
If arbitration is not an option, the parties agree that the exclusive jurisdiction for resolving any disputes related to these Terms shall be the competent courts located in Prague, Czech Republic. Both parties submit to the jurisdiction of these courts and waive any objections to venue or forum.
13.5 Class Action Waiver
You agree that any disputes arising out of or in connection with these Terms will be resolved on an individual basis, and that you will not participate in any class action, collective action, or representative proceeding against Visual Market s.r.o. or its affiliates.
13.6 Language of Proceedings
Any legal action, arbitration, or other proceedings will be conducted in Czech. If any translation of these Terms or any related documents is provided, the original Czech version shall prevail in case of any discrepancies.
14. Miscellaneous
14.1 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
14.2 Force Majeure
We shall not be held liable for any delay or failure to perform our obligations under these Terms due to causes beyond our reasonable control, including but not limited to natural disasters, war, terrorism, strikes, or government action.
14.3 Entire Agreement
These Terms, together with our Privacy Policy and any other legal notices or policies posted on the Website, constitute the entire agreement between you and Visual Market s.r.o. with respect to your use of the Website.
